Where there is an offer to supply products to the consumer on the basis of “free examination”, “free trial”, “free approval” and the like, it should be made clear in the offer who will bear the cost of returning products and the procedure for returning them should be as simple as possible. Any time limit for the return should be clearly disclosed.

The CAN SPAM Act (we’re not talking about a can of Spam, just to be clear) was put in place in 2003 and sets some clear guidelines for staying legal. Breaking the laws can result in up to $16,000 in fines. (That’s some expensive emails to send if you ask me.) Here are a few of the incriminating acts we need to stay away from if we want to be legal and ethical marketers:

Most unsuspected marketers are not aware of this latter point; it’s a waste of time and money to buy a huge number of email addresses if there’s not an email transmission company that is willing to transmit the email list. Explain clearly what people will receive in return for their emails: tips, tricks, news, case studies, special offers, promotions, or whatever you will send them.
